HC delivers a split judgement: all sides pleased though no resolution of the issue
The much awaited judgement on the disqualification of 18 MLAs by the Speaker of the TN Assembly only extended the suspense since the 2-judges bench headed by the Chief Justice Indira Banerji delivered a split verdict. While the Chief Justice herself felt the Court will not interfere with the decision of the Assembly Speaker and quoted several SC judgments to back her order, the other judge, Justice Sundar has found the order of the Speaker bad in law and so has struck it down. This means the case will now be put up to a third senior judge or a fresh 3-judge bench to hear the case all over again and come to a conclusive judgement. The CJ has mentioned that a senior judge, not her will name the judge/judges to take up the case.While the ruling dispensation jointly led by EPS and OPS would feel a little relieved that there is no immediate threat to their government, the TTV Dinakaran faction and the 18 MLAs siding with him/Sasikala feel that the judgement by Justice Sundar gives then heart and hope that they will ultimately win the battle.The truth is even if the verdict had been decisive, the losing side would have approached the Supreme Court. The status quo, therefore continues. Some commentators believe the EPS/OPS duo will make attempts to woo at least 10 out of the 18+ disgruntled MLAs to their side which could make it easy for them to hold on to power till 2019 if not till 2021 when the current Assembly''s term comes to an end.The recent decision of the Election Commission to approve the resolutions passed by the ADMK doing away with the post of General Secretary and making the dual leadership of Co-ordinator (OPS) and Co-Co-ordinator (EPS) has also come as a shot in the arm for the duo.Hindusthan Samachar / S.
